OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC) 18
YEARS OF AGE AND OLDER AS OF AUGUST 1, 2009. DO NOT ENTER IF YOU ARE NOT LOCATED
IN THE U.S. (INCLUDING D.C.) OR CANADA (EXCLUDING QUEBEC) AT THE TIME OF ENTRY.

1. Entry. The Sweepstakes begins at 12:00:01 a.m. Eastern Standard
Time (EST) on August 1, 2009 and ends at 11:59:59 p.m. EST on December 1, 2009 (the
"Sweepstakes Period"). To enter, visit www.casereman.com ("Website")
during the Sweepstakes Period, complete the online entry form with all required
information (name, , phone, e-mail address) and submit your entry as instructed.
Limit one entry per person/e-mail address. Proof of entry submission will not be
deemed proof of receipt by Sponsor or Administrator. All online entrants must have
a valid email address. In the event of a dispute regarding an online entry, entries
will be deemed made by the authorized account holder of the e-mail address submitted
at the time of entry, provided such person meets the eligibility requirements of
these rules. "Authorized account holder" means the natural person who
was assigned an e-mail address by an Internet access provider, service provider
or other online organization that is responsible for assigning e-mail addresses
for the domain associated with the submitted e-mail address. The entrant that submitted
the potential winning Sweepstakes entry may be requested to provide proof to Sponsor
that he or she is the authorized account holder for such winning entry. Sponsor
and Administrator are not responsible for: i) lost, late, incomplete, illegible,
damaged, garbled, destroyed, or misdirected entries or e-mail, or entries not received
by Sponsor or Administrator for any reason; ii) any problems or technical malfunctions,
errors, omissions, interruptions, deletions, defects, delays in operation or transmission,
communication failures or human error that may occur in the transmission, receipt
or processing of entries, or for destruction of or unauthorized access to, or alteration
of, entries; or iii) failed or unavailable hardware, network, software or telephone
transmissions, damage to entrants’ or any person’s computer and/or its contents,
or causes beyond Sponsor’s or Administrator’s reasonable control that jeopardize
the administration, security, fairness, integrity or proper conduct of this Sweepstakes;
or iv) any entries submitted in a manner that is not expressly allowed under these
rules; all such entries will be disqualified. All incomplete or otherwise non-conforming
entries will be disqualified. Sponsor reserves the right to void any and all online
entries made through any robotic, automatic, mechanical, programmed or similar entry
duplication method and to disqualify any individual using such a method. Entries
are property of Sponsor and will not be returned.
2. Eligibility.In order to be eligible to participate, each entrant
must be employed as a farmer as a primary occupation, as of August 1, 2009, through
December 1, 2009. Proof of eligibility will be required. Determination of whether
entrant meets the eligibility requirements is at sole discretion of Sponsor. All
entrants must be 18 years of age or older as of August 1, 2009, and upon request
by Sponsor’s personnel, must provide valid identification showing proof of age prior
to completing. NO EXCEPTIONS. Entrants must be legal resident of one of the 50 United
States/D.C. or Canada (excluding Quebec). This Sweepstakes is not open to the general
public. The following are NOT eligible to enter this Sweepstakes: members of the
general public who are not primarily employed as farmers; employees of Sponsor,
its subsidiaries, affiliates and authorized Dealers; and any of the aforementioned
entities’ immediate families (spouse and parents, siblings and children, and each
of their spouses, regardless of where they live) and persons living in the households
of each of these individuals, whether related or not. This Sweepstakes is subject
to all applicable federal, state, provincial and local laws and regulations.
3. Winner
Selection and Odds of Winning. The potential
Sweepstakes winner will be selected from among all eligible entries by a random
drawing on or around December 31, 2009, by the Sponsor, an independent judging organization
whose decisions are final on all matters relating to this Sweepstakes. Odds of winning
the Grand Prize depend upon the total number of eligible entries received by the
date of the drawing. If the potential winner is a resident of Canada, the potential
winner will be contacted by telephone and must correctly answer a timed mathematical
skill question in order to be declared the winner.
4. Prize
and Approximate Retail Value ("ARV").
One (1) Grand Prize package will be awarded, consisting of (1) Case branded 80-piece
field service tool-kit that includes
3/8" drive socket set including; sockets from
1/4" - 1" SAE and 8mm-19mm Metric,5/8" spark plug wrench, 13/16"
spark plug wrench, 3/8" ratchet, 3" extension, 5" extension, universal
joint, breaker bar.
1/2" drive socket set including; sockets from
7/16"-1 1/4" SAE and 13mm-27mm Metric, 1/2" drive ratchet, 5"
extension, 10" extension, universal joint.
Screwdrivers; 4" Flat Blade, #2 Phillips
Combination Wrenches: 3/8"-3/4" SAE and
10mm-17mm Metric
ARV: $263.16 USD/ $283.30 CAD.
ARV is as of date of printing of these Official Rules.
The difference in value of prize as stated herein and value at time of prize notification,
if any, will not be awarded. Prize is non-transferable and no cash equivalent or
substitution of Prize is offered, except at the sole discretion of the Sponsor.
If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves
the right to substitute prize with another prize of equal or greater value. All
federal, state, provincial or local taxes, and any registration, license, fees and/or
costs related to prize acceptance and/or use are the winner’s exclusive responsibility.
5. Winner
Notification. The potential winning eligible
entry will be contacted by telephone, mail and/or e-mail within approximately seven
(7) days after the drawing. Winners are subject to verification, including verification
of age. If prize notification letter or any prize is returned as undeliverable,
the corresponding prize will be awarded to an alternate winner. Sponsor is not responsible
for any change of mailing address and/or telephone number of entrants.
The
potential winner may be required to sign and return a notarized Affidavit (or Declaration)
of Eligibility, Liability Release, and a Publicity Release, within seven (7) days
of initial notification. Failure to comply will result in forfeiture of prize and
selection of an alternate winner.
6. General
Terms. By participating, entrants agree
to these Official Rules, which are final and binding in all respects and that all
issues and questions concerning the construction, validity, interpretation and enforceability
of these Official Rules, participant’s rights and obligations, or the rights and
obligations of the Sponsor in connection with the Sweepstakes, shall be governed
by, and construed in accordance with, the laws of State of Wisconsin without giving
effect to any choice of law or conflict of law rules. By entering, entrants consent
to the jurisdiction and venue of the federal, state and local courts located in
Racine County, Wisconsin. If for any reason this Sweepstakes cannot be executed
as planned, for reasons including but not limited to infection by computer virus,
bugs, tampering, unauthorized intervention, fraud, technical failures, or any other
causes beyond the control of Sponsor or Administrator that corrupt or affect the
security, administration, fairness, integrity, or proper conduct of this Sweepstakes,
or if this Sweepstakes is compromised or becomes technically corrupt in any way,
electronically or otherwise, Sponsor reserves the right to terminate the Sweepstakes
in its sole discretion. Sponsor reserves the right, at its sole discretion, to disqualify
and prosecute any individual who tampers with or attempts to tamper with the entry
process. If the Sweepstakes is terminated before the scheduled end date, Administrator
will select the winner by random drawing from among all eligible, non-suspect entries.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE
CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES
MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON
TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Limitation of Liability.
As a condition of entering, entrants agree
and agree to confirm in writing): (a) to release Sponsor, its affiliates, subsidiaries,
retailers, sales representatives, distributors and Administrator, and each of their
officers, directors, employees and agents ("Promotional Parties"), from
any and all liability, claim, loss, damages or injuries of any kind arising from
or incurred with respect to the awarding, receipt, possession, and/or use or misuse
of any prize, including any traveling related thereto (b) under no circumstances
will entrant be permitted to obtain awards for, and participant hereby waives all
rights to claim, punitive, incidental, consequential, or any other damages, other
than for actual out-of-pocket expenses; (c) all causes of action arising out of
or connected with this sweepstakes, or any prize awarded, shall be resolved individually,
without resort to any form of class action; and (d) any and all claims, judgments,
and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’
fees and court costs. Except where prohibited by law, Winner grants (and agrees
to confirm this grant in writing, if requested) permission for Sponsor and those
acting under its authority to use his/her name, photograph, voice and/or likeness,
for advertising, promotional and/or publicity purposes in any and all media now
known or hereinafter invented without territorial or time limitations and without
compensation.
